Welcome to VoltYard. By accessing or using voltyard.com.au ("the platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

1. About VoltYard

VoltYard is a free online marketplace that allows Australian EV owners, buyers, wreckers, dealers, and mechanics to list and find EV cars (new and wrecked) and parts. VoltYard is a venue only. We are not a party to any transaction between buyers and sellers.

VoltYard is an independent marketplace and is not affiliated with, endorsed by, or connected to any vehicle manufacturer. Brand names and model names are the property of their respective owners.

2. Eligibility

You must be at least 18 years old to post listings or submit enquiries on VoltYard. By using the platform, you confirm that you are 18 or older.

3. Free to list

Listing on VoltYard is free. We do not charge sellers any fees to post listings, and we do not take any commission on transactions. This may change in the future, in which case we will provide notice before any fees apply.

4. Listing approval

All listings are subject to review and approval by VoltYard before they appear publicly on the platform. We reserve the right to approve, reject, or remove any listing at any time, for any reason, without notice.

5. Seller responsibilities

Sellers are responsible for:

  • Ensuring all listing information is accurate, complete, and not misleading.
  • Only listing parts that are legally owned and available for sale.
  • Not listing stolen, counterfeit, or illegal items.
  • Responding promptly to buyer enquiries in good faith.
  • Completing transactions that they agree to with buyers.

6. Prohibited listings

The following listings are not permitted on VoltYard:

  • Stolen or illegally obtained vehicles or parts.
  • Counterfeit or replica parts represented as genuine.
  • Parts that have been tampered with in a way that makes them unsafe.
  • Any item that is illegal to sell under Australian law.
  • Non-EV vehicles, or items unrelated to the EV marketplace's purpose.

7. No liability for transactions

VoltYard is a venue only. We do not inspect, verify, or guarantee the accuracy of any listing. All transactions are conducted directly between buyers and sellers. VoltYard is not responsible for:

  • The accuracy, quality, safety, or legality of listed vehicles or parts.
  • The ability of sellers to complete a sale.
  • Any loss, damage, or dispute arising from a transaction.
  • Vehicles or parts that are not compatible, defective, or not as described.

Buyers are strongly encouraged to verify vehicle condition, part compatibility, and roadworthiness before completing a purchase. Where possible, arrange to inspect in person.

8. Enquiries and contact details

When a buyer submits an enquiry, their contact details (name, email, and optionally phone number) are shared with the seller via email. By submitting an enquiry, buyers consent to this sharing. Sellers must not use buyer contact details for any purpose other than responding to the specific enquiry.

9. Intellectual property

By posting a listing, you grant VoltYard a non-exclusive, royalty-free licence to display your listing content (including photos, title, and description) on the platform and in search engine results for the purpose of operating the marketplace.

10. Disclaimer of warranties

VoltYard is provided "as is" without any warranties of any kind, express or implied. We do not guarantee that the platform will be available at all times, error-free, or free of harmful components.

11. Limitation of liability

To the maximum extent permitted by Australian law, VoltYard and its operators will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform or any transaction conducted through it.

12. Changes to these terms

We may update these Terms of Service from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

13. Governing law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
